- The prize draw (the “Prize Draw”) is open to people aged 18.
- “The Survey” refers to the survey that was being completed and within which included a link to these prize draw terms and conditions.
- Employees or agencies of Energy Saving Trust (“We”), Home Energy Scotland or their family members, or anyone else connected with the Prize Draw may not enter the Prize Draw.
- Entry into the Prize Draw is optional. To enter the Prize Draw you need to complete the Survey and answer the relevant question to opt in to the prize draw; including the provision of your name and contact details.
- Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions and agree to the use of their name and contact details to identify them as a winner in the Prize Draw (if applicable).
- Only one entry per person.
- The closing date of the Prize Draw is specified in the Survey. Entries received outside this time period will not be considered.
- One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process. The draw will take place on the date specified within the Survey.
- The winner will receive the Prize specified within the Survey.
- The winner will be notified by email on or before the date specified within the Survey; and must provide a postal address to claim their prize. If a winner does not respond to Energy Saving Trust within 14 days of being notified by Energy Saving Trust, then the winner’s prize will be forfeited and Energy Saving Trust shall be entitled to select another winner in accordance with the process described above (and that winner will have to respond to notification of their win within 14 days or else they will also forfeit their prize). If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner’s prize will be forfeited and Energy Saving Trust shall be entitled to select another winner.
- The prize will be sent to the winner by Energy Saving Trust via post.
- By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined in paragraphs 4 and 9 above.
- By entering the Prize Draw, the prize winner agrees to Energy Saving Trust retaining their personal data relating to this competition for seven years to comply with HMRC auditing requirements. After seven years from the date of last contact, Energy Saving Trust will destroy the prize winner’s contact details. During this time Energy Saving Trust will not use the prize winner’s personal data for anything other than contacting them about their Prize Draw entry, unless otherwise agreed, and for the purposes outlined in paragraphs 4 and 9 above.
- For all other prize draw entrants, contact details will be destroyed after the prize winner is determined and the prize is sent out, unless the entrant has contacted the organisation for any other purpose, in which case Energy Saving Trust’s normal retention policy will apply.
- Energy Saving Trust accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered as a result of entering the Prize Draw or accepting / using a prize. Nothing in these Terms and Conditions shall exclude the liability of the Energy Saving Trust under law for fraud or fraudulent misrepresentation, or for death or personal injury resulting from the Energy Saving Trust’s negligence.
- The Prize Draw and these Terms and Conditions will be governed by English law and entrants to the Prize Draw submit to the non-exclusive jurisdiction of the English courts.
- The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
- Energy Saving Trust retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available, amend these terms and conditions or to withdraw the prizes at any time.
